Town of Clyman Plan Advisory Committee Meeting Clyman Town Hall 735 Main Street March 25, 2010 @ 6:30 pm BOARD ATTENDANCE - Mike McLay, Mary Kreuziger, Rick Firari, Mark Othmer, Tom Peterman, Jeff Retzlaff, Vice Chairman Dave Blank, Mark Holl & Stan Jones. ABSENT - Chairman Pat Morrison, Jeff Crum, & Tim Huber The meeting was called to order by Vice Chairman Dave Blank at 6:35 pm. APPROVE AGENDA - Mike /Tom made motion to approve agenda. Motion carried MINUTES - Rick/Mike made motion to approve last month's minutes. Motion carried. DISCUSS FARMLAND PRESERVATION - The PAC Members went over the draft version of the Ordinance Creating a Farmland Preservation Zoning District in the Town of Clyman Zoning Ordinance. Jeff explained that with this Ordinance we are allowing landowners to decide if they want to be in the Farmland Preservation Program. He is not sure if the County & State will allow us to provide a map that is currently blank. Discussion held about holding a public hearing and sending certified letters to all land owners making them aware of the Farmland Preservation Program and if they want to participate they would have to come to the public hearing. Stan explained that he wants it left up to the citizens to decide how they want to be zoned. Jeff explained that by sending in a blank map this would allow the landowner to choose. Further discussion was held. The PAC decided to have a public hearing in May with the Plan Commission. This would allow time to send a postcard to everyone and send a letter to specific landowners based on the current maps. The PAC advises the Plan Commission to table the Ordinance until May when we have a public hearing. REVIEW & REVISE MAPS - Village of Clyman Lagoons are not on all the maps. It was also noted that the Hogsback lagoon is not on all the maps. Jeff will make county aware of the change. REVIEW 2030 PLAN DRAFT ELEMENTS - Chapter 3 Transportation. Jeff was advised to work with Town Chairman Dave Blank and Clerk, Chris Spilker regarding the Town Road Deficiencies policy. This is a system that will be rating the quality of town roads 1 through 4. Jeff also explained in the Transportation Goals & Objectives section; Policies #6 Adopt road access and driveway regulations that prohibit and/or discourage the creation of new parcels having direct private driveway access to STH 26 and 16-60 that do not match to existing or planned public street intersections and/or median openings. Discussion was held regarding private driveway vs. town roads. The PAC Members discussed limiting shared driveways to the 2030 plan to match our zoning. REVIEW & RECOMMEND (NON-FARM) LAND USE & DEVELOPMENT POLICIES - Jeff explained that the PAC needs to create policies regarding non-farm land. Jeff explained this was done in 1999 with the Land Use Plan. He explained the PAC should review the 1999 Land Use Plan and recognize changes to adopt into the 2030 plan. The PAC reviewed the survey results with regards to nonfarm developments. The survey results showed landowners should the largest majority of commercial development be adjacent to the Village. The PAC discussed commercial development on the major highways. Further discussion on this topic will take place at the next meeting. Town of Clyman Plan Advisory Committee Meeting Clyman Town Hall 531 Morgan Street February 18, 2010 @ 6:30 pm. WORKING LANDS PROGRAM PRESENTATION - Dean Perlick did a presentation on the Farmland Preservation Program overview. He explained that currently for 2010 the Town of Clyman is not participating in the Farmland Preservation Program. Under the old law, landowners were able to participate in the program only if the landowner entered in to an agreement with the state. This way the Town was not involved in the process. While the new law continues the use of old agreements, the Town must get an approved AEA in order to allow landowners up for renewal or new to the program to participate by an agreement. He further explained that the current average Farmland Preservation Program Tax Credit in Dodge County is $3.00 - $3.50/acre. The new system increases tax credits. Eligible landowners may collect one of the following tax credit amounts: $5.00 per acre for land entered into a Farmland Preservation Agreement (AEA requirement). $7.50 per acre for land with the Farmland Preservation Zoning District. $10.00 per acre for land within the Farmland Preservation Zoning District and land that was entered into a Farmland Preservation Agreement (AEA requirement). Dean handed out a map showing all participating land owners who are currently involved in the Town of Clyman. It was explained that if the Town of Clyman adopts an ordinance to become part of the Farmland Preservation Program individual land owners would still have the option to participate or not participate. However, there is a conversion fee to rezone if you opted in or opted out of the program. The Conversion Fee is 3 times the highest use value for agricultural land assessment. Example: The 2010 agricultural use value tax assessment for the Town of Clyman is $306/acre. The land conversion fee would be $918/acre because $306 x 3 = $918/acre. The new nonfarm residential development in the Farmland Preservation Zoning District will require a Conditional Use Permit and will need to meet the identified density standard/ratio. Example: If you created a new nonfarm residential lot of 1.0 acre you would need to have at least 21.0 acres of farmland (including a farm residence on a separate parcel) to meet the 1 to 20 ratio (5% rule). A 100 acre farm parcel would be allowed about 5 acres (4.76 acres) of nonfarm development. In order for the Town of Clyman to participate it has to match the Zoning and the Comprehensive Plan. Then it has to be approved by Dodge County and finally be State Approved by the Department of Agriculture Trade & Consumer Protecting. Dean explained that the Town of Clyman has a few options: 1.Update Town Zoning Ordinance (hire consultant or work
with County) Jeff Retzlaff recommended that we need to work with the Town of Clyman landowners and try to determine if there is a large number of land owners who want to participate in it. Dean explained that about 50% of Towns are planning on participating in Dodge County. There is a State cap of $27 million and then it would be prorated for the following year. There is a working lands website that has more information and maps. The website is http://workinglands.wi.gov DATCPWorkingLands@wisconsin.gov Jeff Retzlaff explained that we can have the Town of Clyman's Comprehensive Plan allow land owners that are currently in the Farmland Preservation Program to stay in the plan. Dean explained that landowners who are currently in the Farmland Preservation can negotiate their current contract with the County. The other landowners who are currently not in the program have the option to opt in when they want by doing a rezoning. He explained that once a year the Zoning Board could then accept applications for anyone who is interested in opting in. The Zoning Board would create a Zoning district for this program but would not put anyone into this district unless the landowner requests it. Pat/Tom made a motion to create a new Farmland Preservation District to allow Town of Clyman Land Owners to take advantage of Working Lands Conservation Program. Motion carried. Jeff Retzlaff will draft the ordinance to adopt a new district for Farmland Preservation to be passed by the Plan Commission for the March 2, 2010 meeting. Jeff handed out a number of maps to include a Regional Setting Map, a Functional Classification of Highways & Locations of Railroads & Airports, School District Boundaries, Utilities and Community Facilities, Prime Agricultural Soils, Wetlands, Watersheds, Streams and Surface Water, Floodplains map, Environmental Corridors, Existing Land Use, 2030 Future Land Use, & Existing Town Zoning. Jeff asked that the PAC Members look at all the maps but really look at Map #4 Utilities & Community Facilities for any changes. There are currently two Flood Plain Maps however the PAC will only be submitting the one in Red (FEMA Map) to the County for the Comprehensive Plan. Jeff also handed out the drafted version of Chapter 3, Transportation. He asked that all members look over the drafted version and bring any changes to the next meeting. The PAC members reviewed the Existing Land Use Map. They submitted a few changes. It was requested that any additional changes should be brought to the next meeting. APPROVE AGENDA - Chairman Pat Morrison approved the agenda in writing due to the fact he did not approve prior to the meeting. NEXT MEETING DATE: Next Meeting date will be March 18, 2010 at 6:30 pm. MINUTES - Mike/Dave made motion to approve minutes and presented. Motion carried. GOALS AND OBJECTIVES - Jeff explained the July workshop responses and the 1999 land use is how he drafted the goals and objectives presented to the PAC for the Town of Clyman. Jeff explained he will go through each goal and objective for discussion. VISION STATEMENT - The Vision Statement was read aloud. The PAC had no comment and was comfortable with the drafted vision statement. FARMLAND PRESERVATION AND TOOLS - A spreadsheet and information were presented to the PAC located in the binders they received at the first meeting. Jeff asked for discussion regarding farmland preservation because the majority of the township is interested in preserving farmland. He explained there are county, state, and town “tools” available in preserving farmland. This would include the state setting aside funds to purchase bonds to help purchase easements of farmlands and allow the farmer to work the lands and help preserve the “worked” farm lands. The money is currently not available but the program is currently in the process of being finalized. Jeff explained the current zoning regulation for the Town of Clyman limits the amount of parcel splits in the Township to continue the preservation of farmland. He further explained other surrounding areas land splits and zoning requirements in regards to farmland agriculture splits. It was recommended during PAC discussion that the Plan Commission do a site review prior to approving/denying land parcel splits. Pat explained that it is in the zoning and in the past it was not enforced but is going to be enforced going forward. Jeff explained that there are 24 townships in Dodge County but only 6 or 7 have adopted county zoning. All others have drafted their own zoning regulations to maintain local control. He did explain there is a few that do not have any zoning requirements at this time. He showed a 2005 map of all land in Dodge County that is participating in the State Farmland Preservation. This map is available at Dodge County for anyone who may be interested in receiving a copy. Jeff handed out a pamphlet he received from Dodge County drafted for distribution on January 1, 2010. If someone is interested in rezoning out certified A-1 Exclusive Agricultural in the Townships of Calamus, Leroy, Lomira, Oak Grove, Shields, or Trenton you will be charged a fee. This pamphlet is also available to anyone interested at Dodge County. Jeff recommended that the Town Board, Plan Commission, PAC, and anyone else interested should participate in having Nate from Dodge County come and do a presentation regarding what the County is interested in obtaining from the Town of Clyman with regards to farmland preservation. Discussion was held regarding economic development for the future of Clyman. The PAC members at this time want the comprehensive plan to work with the Zoning Book. Currently the town has invested a lot of time, money, and towns citizens' interests in creating and enforcing the Zoning requirements. It was acknowledged that it's time to strictly enforce the zoning requirements currently adopted. NEXT MEETING DATE: February 18, 2010 @ 6:30 PM. (Nate from Dodge County will be doing a presentation). Jeff Retzlaff explained at the next meeting he would like the PAC to review the drafted versions of The Introduction, Chapter One, and Chapter Two. PAC Meeting September 24, 2009 @ 7:30 pm Clyman Town Hall ATTENDANTS: Jeff Retzlaff, Mike McLay, Tim Huber, Rick Firari, Mary Kreuziger, Chuck Burkholz, Chris Spilker, Dave Blank, Marjorie Gahlman, Jeff Crum, Stan Jones. Mark Holl, Pat Morrison CALL TO ORDER: Meeting was called to order by Vice Chairman Dave Blank at 7:30 pm. (Chairman Pat Morrison arrived at 7:40 pm). PUBLIC COMMENTS: None COMMUNITY SURVEY RESULTS: 167 surveys were turned in. That's 48% of what was sent out. Jeff Retzlaff went through the survey results. The survey results will be available on the website. Jeff recommended that with these results the PAC committee should now breakdown the questions further. Doing an analysis to the questions would give you a better idea of what groups support or do not support growth as well as the future of the town. Further discussion regarding the numbers on the survey. Comment made that the largest age group is 45-54 years of age making up 28.4% of the towns residents. Possibly showing there may be a lot of change in the future since the population is made up mostly of adults over 45 years. ISSUES/OPPORTUNITIES ELEMENT: Preserving farmland is still a concern for the township. The numbers also show that the town is developing and increasing in numbers of housing units. Further discussion regarding agriculture preservation. PAC members felt that if they create regulations for the township, they will have to define if the citizens in the town want farmland preservation for the farmer, or if they want farmland preservation because they want rural undeveloped land in the township. Further discussion was held regarding farmland preservation and incorporating it into the 2030 Comprehensive Plan. PAC members wanted to know if we could do a comparison with other local farming communities. Jeff will get some comparables from other local communities that have dominant farmland in their community and report back to the members. Jeff is also going to run age groups vs. farmland preservation on the surveys. Discussion about keeping the 2030 Comprehensive Plan as general as possible and still doing what is required by the State. The PAC was also reminded they can create a 2030 Comprehensive Plan to meet the state's requirements today and require it be re-looked at in the future. DEBRIEF JULY 30TH PUBLIC WORKSHOP: Jeff explained at the next meeting he is going to go over goals and objectives for the town based on the survey. This will include the July 30th workshop statements and the 1999 Land Use Plan. MINUTES - Motion made by Mark/Jeff to accept minutes as presented. Motion carried. COMMUNITY OPINION SURVEY - Jeff went over the “draft” of the Community Opinion Survey. Question raised about if there is more than one adult in the household who would fill it out. Jeff explained that we will have additional survey's available online or through the clerk. Jeff explained that he tried to keep the questions general. Question raised about rental property. Jeff and the clerk will work to get a list of rentals in the Town of Clyman. Jeff explained in the cover letter we could list instructions for multiple adult households looking for more than one survey. Suggestions given included downloading additional copies from the website & keeping extra copies at the clerk's office. After discussion the PAC Committee decided to delete questions #12 #13 & #14. Discussion regarding today's agriculture farms. Jeff explained 10 years ago preserving agriculture land was the town's top priority. Today agriculture land is becoming unaffordable for purchase to today's farmer. Discussion regarding the definition of agriculture farms today. For the purpose of this survey Jeff explained that agriculture by definition is “open space uses” that involve traditional farming , large scale operational farming, & hobby farms. It does not to include non farm residential, commercial, or industrial. The PAC explained that we change the verbiage in #16 to eliminate the words “Allow and Encourage” from the question. Jeff Crum recommended using the word “support”. Question raised about if Multi-family homes. Jeff explained that some communities like to have Multi-family for the seniors. Today's mound systems would allow for multi-family if citizens show support through the survey. PAC recommended that #16 read as followed: How important is it that the town has the following housing options available in the town. PAC would like to add to # 16 “High End Residential Housing” as an option because it does not cost the town much to allow it, however it is a good revenue source. #17 Gene supported the idea of adding Golf Courses to the list and also put answers to all questions in alphabetical order. #17 PAC would like the question to read: How important is it that the town have the following kinds of “Future” Agricultural, Commercial, and Industrial development in the Town of Clyman. #17 Gene recommended adding Hobby farm/Horse farm to the list. PAC felt a category for Agricultural-related businesses be added. Pat would like to add more agricultural questions in regards to the size of the operations. Jeff will reword the categories and represent it to the PAC. #19 PAC recommended removing “or remain the same over the next twenty years” in the question. PAC would also like to have the answer added about decreasing the population. #20 Individual lots should be changed from 1-5 to 1-3 acres. Discussion regarding not allowing potential future developments if the land owner divides his property and does not preserve the farm/agricultural land. Pat recommended using the same list as question #18. Jeff agreed and will change #20 to have the same list of question #18. #25 Dave would like to add local Law Enforcement to the Town of Clyman. #26 PAC would like to add a question regarding the Village annexing land in the Town. Discussion regarding annexation. Jeff explained the town should use leverage in regards to the village annexing land in the town. Pat recommended using the Fire Department as the town's leverage if necessary. Pat would like to see questions regarding conserving preservation and protection of environmentally untouched land in the town of Clyman. Jeff will construct a question regarding how important land preservation is for the town. Jeff explained that he receives about 40% of survey's returned back. The next workshop would like the done at the Lion's Hall on July 30, 2009 at 7:30 pm. 1st Comprehensive Plan Advisory Committee (PAC) May 21, 2009 at 7:00 p.m. Attendences: Tom Pederman, Stan Jones, Tim Huber, Gene Bogard, Mike McLay, Rick Firari, Mark Holl, Mark Othmer, Jeff Crum, Jeff Retzlaff, Dave Blank, Pat Morrison The 1st Comprehensive Plan Committee was called to order by Dave Blank at 7:04 p.m. with Mary Kreuziger, absent. Chairman Selection: Tim Huber/Tom Pederman nominated Dave Blank as Comprehensive Plan Chairman. Eugene Bogard/Rick Firari nominated Pat Morrison for Chairman. Hand vote was called. 3 hands voted for Dave Blank as Chairman. 5 hands voted for Pat Morrison as Chairman. Pat Morrison is the PAC Chairman. Motion carried. Tom Pederson/Mike McLay to nominate Dave Blank as Vice Chairman. Motion carried. Dave/Gene made motion to set time for future meetings to 7:30.p.m. Motion carried. Consultant & Committee Introduction: Jeff Retzlaff had everyone on the committee introduce themselves. Project Summary: Jeff went over the binders and the requirements for being a committee member. He then explained the Comprehensive Planning Law located in the Binder, Chapter 9. Question raised if the group or Jeff Retzlaff will be deciding on issues. Jeff clarified that the committee decides and Jeff will give recommendations but it is up to the committee to decide. He then explained the timeline located in Chapter 1. Discussion held about when to hold future meetings. Future meetings will be held on the third week of the month on a Thursday. PAC Expectations: Jeff explained that he would like to see either postcards or postings for citizens to get local citizens involved. It will be up to the committee to decide if postcards or survey's will be sent to the citizens. Jeff explained that regarding the public participation he has scheduled open workshops for citizens to come and be prepared with the topic of the evening being discussed. He will also have public comment on every agenda for each meeting. The PAC will be required to follow the Zoning Codes when creating a plan. Jeff explained that some communities get very specific in their plan however it will be up to this committee to decide how detailed the Town of Clyman Comprehensive Plan will be. Jeff also explained he wants all meetings to last two hours. Jeff also explained he will distribute most of the information prior to the next meeting. He also explained that committee members need to call the chairman if not able to attend a meeting. Public Participation Plan: Jeff explained the participation plan located in Chapter 2. Jeff also explained the town board will pass all final resolutions and will make all final decisions. If the town board does not approve the plan they have the authority to send it back to the PAC. The PAC wants a questionnaire and also do workshops in July. Stan/Dave made motion to send questionnaire to local citizens. 1 opposed. Motion carried. The PAC decided that multiple choice would be favored over yes/no questionnaire. Dave/Stan made motion to meet in June to come up with workshop and July would be a public workshop for citizens input. Motion carried. Jeff passed out a Comprehensive Plan from the Town of Lowell as an example. Subcommittees: Jeff would be interested in receiving information from anyone in the town of Clyman who would have photos or information regarding the history of the Town of Clyman. Land Use Verification: The mapping at Dodge County is currently about five years old. Jeff would like members of Committee to take sections of the maps and update as necessary. Land Use Plan Summary: Jeff explained the Land Use Summary in Chapter 5. He explained that in 1996 a community survey was done with 97% of citizens being concerned about conversion of farm to other uses. PAC Member Issues: Stan asked if for efficiency purposes he wanted to know if the Town/Village would be combined in years to come. Jeff explained that their would need to be legislative changes for that to happen. Jeff further explained that the PAC could propose this to the Village and invite them to some of the meetings. Mike questioned if future committees can make changes in the future. Jeff explained that there is a statute to revise the plan every years. The PAC can have it revised/reviewed more often. Jeff recommended the PAC members bring a list to the next meeting a list of issues regarding the plan for the Town of Clyman and bring supporting documents if available Pat would like anyone interested in addressing their plan to the PAC be put on the agenda. Dave would like public comment be put at the beginning meeting. He also recommended the PAC have citizens fill out comment form. Pat agreed. Dave/Gene Meeting adjourned at 9:15 p.m. |
